3.1 Eligibility

Use of the platform is permitted only by individuals who are at least 18 years of age and capable of forming a binding contract under applicable law. By using the platform, you represent and warrant that you meet these requirements.

We may restrict access to certain features or services to users located in specific jurisdictions and we reserve the right to refuse access to the platform at our sole discretion.

3.2 Account Registration

To access certain features of the platform, including submitting artwork or placing an order, users may be required to register for an account. You agree to provide accurate, current and complete information during the registration process and to keep your account details updated at all times.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect any unauthorized use or breach of security, you must notify us immediately.

3.3 Guest Checkout

Buyers may place orders without creating an account by using the guest checkout option. In such cases, you agree to provide accurate contact and delivery information to ensure proper order fulfillment. Some features, such as order history and tracking, may be limited for guest users.

3.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you suspect any unauthorized use or breach of security, you must notify us immediately.

3.5 Account Restrictions

We reserve the right to suspend or terminate your account if we believe you have violated these Terms or if your conduct may harm the platform, other users or our business reputation. You may not create an account using a false identity, impersonate another person or use someone else's account without permission.

4.1 Artist Onboarding

Artists may apply or be invited to list their artwork on the platform. Rangbhoomi reserves the right to approve, reject or curate submissions based on artistic quality, originality and relevance to the platform's values. Approved artists may be required to provide high-resolution images of their work and complete an onboarding process.

4.2 Ownership and Rights

The artist retains full ownership of all intellectual property rights in the submitted artwork. Nothing in these Terms transfers ownership of the artwork to Rangbhoomi.

4.3 License Grant

By submitting artwork to the Platform, the Artist grants Rangbhoomi a non-exclusive, worldwide, royalty-based license to:

• Reproduce and create physical or digital prints of the artwork for the purpose of sale;
• Use the artist's name and artwork in promotional materials (online and offline), including but not limited to social media posts, email campaigns, event banners, printed flyers and packaging;
• Display the artwork publicly on the Platform, in exhibitions, in editorial content etc relating to the Artist or the Platform.

This license is valid for the duration the artwork remains listed on the Platform and extends for the fulfilment of pending sales even after de-listing.

4.4 Royalty Payments

Rangbhoomi will pay the Artist a royalty fee for each successful sale of a print of the submitted artwork, as per the rates specified by the artist in artwork upload form and payment schedule specified in the artist FAQ.

No royalty shall be due for:

• Use of the artwork for marketing, promotional, or editorial purposes;
• Orders that are cancelled, refunded or returned by the buyer;
• Internal mock-ups or quality testing purposes.

4.5 Marketing & Promotion

Use of the artwork in promotional or marketing contexts (whether digital or physical) shall not constitute a sale and the Artist shall not be entitled to royalties for such use. However, the Artist will be credited wherever reasonably possible and appropriate.

4.6 Artist Warranties

By submitting artwork, the artist confirms that:

• They are the sole creator or hold all necessary rights to license the artwork
• The artwork does not infringe any copyright, trademark or other third-party rights
• The work is not misleading, defamatory or otherwise unlawful
• They have not submitted content that is generated or derived from unauthorized sources

4.7 Right to Revoke

Artists may request deactivation of their artwork from the platform by providing 15 days' notice. Rangbhoomi retains the right to continue using the artwork to fulfill any pending or in-process orders and to keep archival or promotional material that was already created prior to the removal.

4.8 Artwork Adjustments

The platform may make minor modifications to artwork files, such as upscaling, cropping or color correction, for the purpose of printing or formatting. These changes will not alter the artistic substance of the work.

5.1 Role of the Platform

Rangbhoomi acts as an intermediary between artists and buyers. We facilitate the listing, promotion and sale of licensed prints on behalf of the artist. The platform does not claim ownership of the artwork and does not sell the original work unless explicitly stated.

5.2 Order Placement

Buyers may purchase prints through the platform using available payment methods. All prices are listed in Indian Rupees and include applicable taxes unless otherwise stated. Orders are subject to availability and confirmation.

5.3 Print Quality

Prints are produced using high-quality materials and standard framing options as described on the product page. While we make every effort to ensure accuracy, slight variations in color or finish may occur due to screen settings or material differences.

5.4 Delivery and Fulfillment

Orders are fulfilled through third-party printing and logistics partners. Estimated delivery times are provided at checkout and may vary by location. Delays caused by shipping partners, weather conditions or other external factors are beyond our control.

Delivery will be made to the address provided by the buyer at the time of checkout. Buyers are responsible for ensuring the accuracy of their shipping details. Rangbhoomi is not responsible for failed deliveries due to incorrect or incomplete address information or due to third party mistakes.

5.5 Returns and Refunds

Since most of our prints and frames are made to order, we do not offer returns for reasons such as change of mind, color variation, or personal preferences.

Refunds or replacements will only be issued in the following cases:

• The product is delivered in a damaged condition
• The product is materially different from what was ordered

To request a refund or replacement, the buyer must notify us within 72-hours of delivery, along with photographic evidence. We reserve the right to approve or reject return/refund requests at our sole discretion.

If approved, refunds will be processed to the original payment method within 7 working days or a replacement will be arranged.

5.6 Non-Returnable Items

The following items are non-returnable and non-refundable:

• Customized frames or prints
• Artwork altered or tampered with after delivery
• Products reported after the 72-hour return window

5.7 Ownership of Print

Upon successful delivery, the buyer owns the physical print but does not receive any copyright or reproduction rights. The artwork may not be copied, reproduced, resold or used for any commercial purpose without prior written consent from the artist or Rangbhoomi.

5.8 Cancellation by the Platform

We reserve the right to cancel an order in cases of suspected fraud, pricing errors or product unavailability. If an order is cancelled, the buyer will be notified.

5.9 Framing

Framing options are offered as displayed on the product page and may vary by artwork size or availability. Actual frame colors or finishes may differ slightly due to screen display or material variations. Framed prints are typically made to order and are not eligible for return unless damaged during transit. Buyers must report any such damage within 48 hours of delivery.

6.1 Pricing and Taxes

All artwork print prices are listed in Indian Rupees and include applicable taxes unless stated otherwise. Rangbhoomi reserves the right to modify prices at any time. The price at the time of order placement will apply.

6.2 Withdrawal, Tax Deductions and Invoice Authorization

Artists may withdraw any amount from their royalty balance at any time using the available withdrawal feature, subject to platform availability and payment processing timelines.

We reserve the right to deduct Tax Deducted at Source (TDS) up to 20% on all royalty payments, irrespective of the amount, to ensure compliance with Section 194J of the Income Tax Act.

Authorization to Issue GST Invoice on Behalf of Artist
By registering as a GST-registered artist and using the withdrawal feature on Rangbhoomi, you authorize Rangbhoomi Curation Private Limited ("the Platform") to issue GST-compliant tax invoices on your behalf for royalty and commission payments made to you.

This authorization is granted solely for the purpose of facilitating timely payments and ensuring compliance with Indian GST laws, specifically Rule 46 of the CGST Rules, 2017, which allows a recipient to issue an invoice on behalf of the supplier with prior authorization.

10.1 General Conduct

By using the Rangbhoomi platform, users agree not to engage in any activity that:

• Violates any applicable law or regulation
• Harms, threatens or harasses others
• Attempts to gain unauthorized access to the platform or other users' data
• Interferes with the operation, security or integrity of the platform
• Disrupts the experience of other users (e.g., spamming, fake reviews, manipulation)

10.2 Artist Conduct and Content

Artists are expected to maintain the integrity of the platform and represent their work truthfully. The following actions are strictly prohibited:

• Uploading content that is not owned or properly licensed by the artist
• Submitting misleading titles, descriptions or credentials
• Listing artwork that is plagiarized, defamatory, obscene or otherwise unlawful
• Attempting to bypass the platform's royalty or payout systems (e.g., through off-platform sales)
• Including unauthorized trademarks, copyrighted elements or third-party content

10.3 Buyer Conduct

Buyers agree not to:

• Use purchased prints for reproduction, resale or any commercial purpose unless explicitly licensed
• Misuse the return/refund system
• Submit false or misleading reviews or ratings
• Harass artists or other users through messages or comments

10.4 Community Guidelines and Moderation

Rangbhoomi reserves the right to:

• Remove any content that violates these guidelines or is otherwise inappropriate
• Cooperate with law enforcement or IP holders in case of reported infringements or illegal activity
• Suspend or terminate user accounts in case of repeated or serious violations and even withhold royalty payments

10.5 Legal Action and Damages

Rangbhoomi reserves the right to seek legal remedies, including but not limited to claims for damages, legal costs and injunctive relief, against users or parties who willfully violate intellectual property laws or misrepresent ownership of submitted artwork. Serious cases may be reported to relevant authorities under the Copyright Act, 1957 or other applicable laws.

11.1 Respect for Rights

Rangbhoomi respects the intellectual property rights of artists and third parties. We expect all users to do the same. If you believe that your copyright or other intellectual property rights have been infringed by content posted on the platform, you may file a formal complaint with us.

11.2 How to Report an Infringement

To report a claim of infringement, please send an email to reachout@rangbhoomi.in with the subject line: IP Infringement Notice and include the following:

• A clear description of the work or content that you believe has been infringed
• The exact URL or location on Rangbhoomi where the infringing content appears
• A declarative statement under the penalty of perjury that you are the rights holder or are authorized to act on behalf of the rights holder
• Your full name, contact details and a statement made under good faith that the use is not authorized by the owner
• A signature (physical or digital)

11.3 Our Response

Upon receiving a complete and valid notice:

• We will review the claim and may temporarily remove or restrict access to the allegedly infringing content
• We may contact the uploader of the content and give them an opportunity to respond
• If the issue is resolved, we may reinstate the content or take permanent action as appropriate

11.4 False or Misleading Claims

Submitting false, malicious or misleading infringement notices is strictly prohibited and may result in account termination or legal consequences.

12.1 Platform as a Facilitator

Rangbhoomi acts as an intermediary that enables the listing, promotion and sale of artwork prints. We do not guarantee the success of any artist or the satisfaction of any buyer. All transactions are carried out at the discretion of the parties involved.

12.2 No Warranty

The platform and all related content, features and services are provided on an "as is" and "as available" basis. We make no warranties or representations of any kind, whether express or implied, regarding the availability, accuracy, reliability or suitability of the platform or its content for any purpose.

This includes but is not limited to:

• the sale or success of any artwork
• uninterrupted access to the platform
• protection from data loss
• exact visual match between previews and final printed artwork

12.3 Limitation of Liability

To the fullest extent permitted by law, Rangbhoomi Curation Private Limited and its directors, officers, employees and agents shall not be liable for any indirect, incidental, special, punitive or consequential damages. This includes losses related to profits, goodwill, data or other intangible losses that result from:

• your use of or inability to use the platform
• actions or content from any third party
• unauthorized access to your data
• errors or omissions in any content

This applies even if we have been informed of the possibility of such damages.

12.4 Third-Party Vendors

Rangbhoomi uses trusted third-party service providers for tasks such as printing, framing, payment processing and delivery. While we take reasonable care in selecting and instructing these vendors, we are not liable for any unauthorized actions or misconduct by such vendors that occur outside the scope of services requested by Rangbhoomi. In the event of any known breach, we will take immediate steps including termination of the vendor relationship and legal action if necessary.

12.5 Identity and Authenticity Disclaimer

Rangbhoomi operates as an intermediary platform and does not independently verify the identity of artists or the authenticity of uploaded artworks. Users are solely responsible for ensuring that any content or profile information they submit is accurate and lawful. Rangbhoomi shall not be liable for any losses, damages or disputes arising from misrepresentation, impersonation or identity fraud committed by platform users. If notified of such cases, Rangbhoomi will investigate and may remove the infringing profile or content at its sole discretion.

12.6 Cap on Liability

Our total liability to any user shall not exceed ₹1,000 or the total amount paid by you to us, if any, in the six months prior to the event giving rise to the claim, whichever is greater.

12.7 Force Majeure

Rangbhoomi shall not be held liable for any failure or delay in performance resulting from causes beyond its reasonable control. These include but are not limited to acts of God, natural disasters, war, terrorism, government actions, labor strikes, power failures, internet disruptions or pandemics. During such events, obligations may be suspended for the duration of the disruption.

13.1 Dispute Resolution Process

In the event of any dispute or claim, both parties agree to attempt to resolve the matter amicably through informal negotiation. If unresolved within 30 days, the dispute may be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in English and the seat of arbitration shall be Jaipur, Rajasthan, India.

13.2 Arbitration

These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute or difference arising under or in connection with these Terms shall be resolved through arbitration administered by the Indian Institute of Arbitration & Mediation (IIAM) in accordance with its Expedited Arbitration Rules. The arbitration shall be conducted by a sole arbitrator appointed in accordance with those rules. The language of the arbitration shall be English and the seat of arbitration shall be Jaipur, Rajasthan, India. The proceedings will be conducted online via video conference.

13.3 Binding Award

The arbitral award shall be final and binding on both parties and the arbitration shall be governed by the Arbitration and Conciliation Act, 1996 and any amendments thereof.

13.4 Exclusive Jurisdiction Clause

Subject to the above arbitration clause, the courts in Jaipur, Rajasthan, India shall have exclusive jurisdiction over any matters requiring court intervention, including enforcement of the arbitral award or interim relief. The parties expressly waive the right to initiate or pursue proceedings in any other jurisdiction.

13.5 Class Action Waiver

You agree that any dispute arising out of or relating to these Terms or your relationship with Rangbhoomi shall be resolved on an individual basis. You expressly waive any right to bring or participate in a class action, class arbitration or any other representative proceeding against Rangbhoomi.

Any arbitration or legal proceeding will be conducted solely between you and Rangbhoomi and not with any other user or third party.

14.1 Right to Modify

Rangbhoomi reserves the right to update, modify or replace these Terms at any time, at its sole discretion. Changes may reflect updates to our practices, legal requirements or business operations.

14.2 Notice of Changes

We will make reasonable efforts to notify users of material changes, such as by posting an update notice on the Platform or sending a notification via email. However, it is your responsibility to review the Terms periodically.

14.3 Continued Use

Your continued use of the Platform after changes to the Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Platform and associated services.

15.1 Entire Agreement

These Terms form the complete agreement between you and Rangbhoomi for your use of the Platform. They override any prior agreements, discussions or communications, whether written or spoken.

15.2 Waiver and Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will stay in full effect. Our decision not to enforce any part of the Terms does not mean we waive our right to enforce it later.

15.3 Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written approval. Rangbhoomi may assign or transfer these Terms as part of a business transfer or restructuring.

15.4 No Agency Relationship

Nothing in these Terms creates a partnership, joint venture or agency between you and Rangbhoomi. You agree not to represent otherwise.

15.5 Notices and Communication

We may contact you electronically using the Platform or the email you provided. You agree that such communication satisfies any legal requirement for written notice.
